Milwaukee Impact Driver does not wake up

I have had a very interesting issue my 2850-20 Impact Driver. It decided to stop working. Plug in a battery, led turns on but trigger does nothing. Wait 5 minutes, the led will ignite with trigger depressed but motor won't spin.

Next day, a discovery was made with the Impact Driver.

Step 1-insert battery from charger into 2850-20 impact, doesn't spin motor.

Step 2-insert same battery into any other tool and run it (important step)

Step 3-insert battery back into 2850-20 impact and it will work fine (for a few minutes) every time. After a certain amount of time of inactivity, it won't work again and you will have to repeat Steps 2 & 3 to get it to work again.

Almost as if there is a computer issue related to battery memory in the machine?

I really hope someone could help me with this...
